Privacy Policy

Autify, Inc. (a corporation incorporated in the State of Delaware, U.S.A., "Autify," "we," "us," or "our") provides this Privacy Policy to inform you about how we collect, use, store, and disclose personal information when you use the Aximo platform and related services (the "Services"). This Privacy Policy applies to all users of the Services, including visitors to our website.

By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you must not use the Services.


1. Information We Collect

1.1 Account Data

When you register for the Services, we collect personal information necessary to create and maintain your account, such as your name, email address, password, and profile details. If you register using a third-party authentication provider (e.g., Google OAuth), we receive basic profile information from that provider. When you create or join an organization, we collect organization details such as the organization name and member roles. Autify acts as the data controller for Account Data.

1.2 Billing Data

When you subscribe to a paid plan, we collect billing and payment information through our payment processor, Stripe, Inc. Autify does not directly store your payment card details. We retain subscription identifiers, billing cycle information, credit usage records, and invoice references necessary to manage your account.

1.3 Service Data

Service Data refers to all content you upload, submit, or that is generated through your use of the Services. This includes, but is not limited to, test sessions, screenshots, video recordings, AI agent conversations, knowledge base documents, code files, workflow configurations, test cases, test plans, and any other data produced during the operation of the Services. Service Data need not contain personally identifiable information by default. You, as the customer, are the data controller for Service Data, and Autify acts as the data processor, processing Service Data solely to provide and operate the Services on your behalf.

1.4 Technical Data

When you access the Services, we automatically collect technical information such as your IP address, browser type, device information, and session identifiers. We also collect usage data related to API key activity for rate limiting and security purposes.


2. How We Use Your Information

We use the information we collect for the following purposes:

  • (a) To provide, operate, and maintain the Services, including managing your account and processing your transactions
  • (b) To power the AI features of the Services, as described in our AI Policy
  • (c) To send transactional communications, including account verification emails, organization invitations, password reset emails, and subscription notifications
  • (d) To improve, develop, and enhance the quality and performance of the Services using anonymized, aggregated data
  • (e) To ensure security, detect fraud, and maintain the integrity of the Services
  • (f) To comply with legal obligations and respond to lawful requests

3. How We Share Your Information

3.1 Third-Party Service Providers

We share your information with third-party service providers who assist us in operating the Services, including AI model providers, cloud infrastructure, payment processing, email delivery, and code integration services. These providers process your information only as instructed by Autify and in accordance with applicable data protection laws. Our current sub-processors are listed in our Sub-Processor List.

3.2 Within Your Organization

Organization administrators and owners have access to all data within their organization account, including test sessions, usage data, and activity generated by any member. By joining an organization, you consent to this access as described in our Terms of Services.

3.3 Legal Requirements

We may disclose your information if required to do so by law, court order, or governmental regulation, or if we believe in good faith that such disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend the rights or property of Autify; (c) prevent fraud or address security issues; or (d) protect the personal safety of users or the public.

3.4 Business Transfers

In the event of a merger, acquisition, reorganization, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

3.5 No Sale of Personal Information

Autify does not sell your personal information to third parties.


4. Data Storage and Security

4.1 Storage Location

Your information is stored on servers located in the United States. By using the Services, you consent to the transfer and processing of your information in the United States.

4.2 Security Measures

We implement appropriate technical and organizational measures designed to protect your information against unauthorized access, alteration, disclosure, or destruction. No method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

4.3 Breach Notification

In the event of a data breach that affects your personal information, we will notify you via email or through the Services as soon as possible and without unreasonable delay, in accordance with applicable law.


5. Cookies and Session Management

The Services use essential session cookies to authenticate your account and maintain your session state. We do not use third-party advertising cookies or tracking pixels.


6. Data Retention and Deletion

6.1 Retention Period

We retain your information for as long as your account remains active or as needed to provide the Services. Upon termination of your Service Agreement, we will retain your information for a period of six (6) months, after which it will be permanently deleted by technical means within one (1) month, unless retention is required by applicable law.

6.2 Deletion Requests

You may request deletion of your personal information at any time by contacting us at legal@autify.com. Upon receiving a verified deletion request, we will delete or anonymize your personal information within a commercially reasonable time, subject to our legal obligations. Please note that:

  • Deletion of your account will result in the loss of all associated data
  • Anonymized, aggregated data that cannot identify you may be retained
  • Data that is required to be retained by law will be retained for the applicable period

7. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete information
  • Deletion: Request deletion of your personal information
  • Portability: Request a copy of your information in a structured, machine-readable format
  • Restriction: Request that we restrict the processing of your information
  • Objection: Object to the processing of your information for certain purposes

8. International Data Transfers

Your information is processed in the United States. If you are located outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. We implement appropriate safeguards for such transfers, including standard contractual clauses where required by applicable law.


9. Children's Privacy

The Services are not directed at individuals under the age of 18. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete such information promptly. 10. Third-Party Links and Services

The Services may contain links to or integrate with third-party websites or services. We are not responsible for the privacy practices of third-party services. We encourage you to review the privacy policies of any third-party services you access through the Services.


11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will use reasonable efforts to notify you by posting the updated Privacy Policy on our website or through other means. Your continued use of the Services after the updated Privacy Policy is posted constitutes your acceptance of the changes.
